NORRISTOWN - A Phoenixville man will spend time in jail for stealing $450 from a Pottstown woman he visited in July.
Joseph Patrick Franzone Jr., 27, of the first block of Cherry Street, was sentenced in Montgomery County Court this week to 11 1/2 to 23 months in county jail, to be followed by two years' probation, after he pleaded guilty to a misdemeanor charge of theft of movable property.
Under the terms of a plea agreement accepted by Judge Richard J. Hodgson, Franzone is eligible for the jail's work-release program. He was also ordered to pay $450 in restitution to the Pottstown woman from whom he stole the money.
According to a criminal complaint filed by Pottstown police, Franzone was visiting the woman's North Franklin Street apartment on July 30. While the woman was taking a shower, Franzone took the cash from the woman's purse and wallet, according to the criminal complaint.
When the woman got out of the shower, she noticed that her purse and apartment door were open and Franzone was no longer in the apartment, according to court documents. The woman told police that Franzone was the only person in the apartment with her at the time the money went missing.
